Agreement to Terms
These Terms & Conditions ("Terms") constitute a legally binding agreement between you and AussieRoomsH3 ("Company," "we," "us," "our") governing your access to and use of the AussieRoomsH3 platform, website, and services (collectively, the "Platform").
By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Platform.
These Terms are governed by the laws of New South Wales, Australia. Users must be at least 18 years of age to use the Platform.
Platform Purpose and Limitations
CRITICAL: Connection Service Only
AussieRoomsH3 is a connection platform only. We facilitate introductions between property owners with spare rooms and renters seeking accommodation. We are NOT:
- A property management company
- A real estate agent or broker
- A rental agent or letting service
- A party to any occupancy agreement between users
- Responsible for collecting rent or holding bond payments
- Responsible for property maintenance or repairs
- A mediator or arbitrator for disputes between users
All agreements, payments, and arrangements are made directly between owners and renters. We provide tools to facilitate these connections but take no responsibility for the outcome of any rental arrangement.
User Accounts and Eligibility
Account Requirements
- You must be at least 18 years old to create an account
- You must provide accurate, complete, and current information
- You must maintain the security of your account credentials
- You are responsible for all activities under your account
- You must not share your account with others
- One person may only have one account (as an owner OR renter, not both simultaneously)
Identity Verification
We may require identity verification through government-issued identification. Failure to provide verification when requested may result in account suspension or termination.
Property Owner Obligations and Restrictions
Mandatory Restrictions
- One Active Property Only: You may only list ONE active property at any time. The property must be your principal place of residence (where you currently live).
- Room Limits: You may rent a maximum of TWO (2) spare rooms in most Australian states and territories. In South Australia ONLY, you may rent a maximum of ONE (1) room to avoid boarding house classification.
- Owner-Occupied Requirement: You must live on the property while renting rooms. This platform is NOT for investment properties, entire-property rentals, or properties where the owner does not reside.
- Ownership Verification: You must be the legal owner or have explicit written permission from the owner to rent out rooms. Mortgage holders must ensure rentals comply with loan terms.
Owner Responsibilities
- Provide accurate property descriptions, photos, and amenity listings
- Disclose all material information about the property and household
- Comply with all applicable local, state, and federal laws
- Maintain the property in safe and habitable condition
- Respond to viewing requests within a reasonable timeframe
- Honor occupancy agreements made through the Platform
- Declare rental income to the Australian Taxation Office (ATO)
- Maintain appropriate insurance coverage
Violation of these restrictions may result in immediate listing removal and account termination.
Renter Obligations
- Provide truthful and accurate information in your profile
- Treat properties with respect during viewings
- Honor occupancy agreements you accept
- Pay rent as agreed with the property owner
- Comply with house rules set by the property owner
- Report any issues or damages promptly
- Vacate the property as required by the occupancy agreement
- Not sublease or transfer the room without owner consent
Occupancy Agreements and Payment Terms
Informal Occupancy Licenses
The Platform facilitates the creation of "occupancy licenses" between owners and renters. These are NOT formal tenancy agreements and are designed to avoid the regulatory requirements of the Residential Tenancies Act in each state.
Occupancy licenses are informal agreements for shared living arrangements where the owner resides on the property. They do NOT provide the same legal protections as formal tenancy agreements.
Direct Payment Requirement
CRITICAL: All rent payments must be made directly between the renter and the property owner. AussieRoomsH3 does NOT:
- Collect, process, or handle rent payments
- Hold bond or security deposits
- Provide payment processing services
- Guarantee payment from renters to owners
- Take responsibility for payment disputes
The Platform provides payment tracking tools for record-keeping purposes only. Users determine their own payment methods and schedules.
No Bonds or Deposits Through Platform
While owners and renters may privately agree on bond arrangements, AussieRoomsH3 does not hold, manage, or facilitate bond payments. Any bond arrangements are entirely between the parties and subject to their private agreement.
AI Compatibility Reports
The Platform uses Google Gemini AI to generate compatibility reports analyzing lifestyle habits, personality traits, and interests between owners and renters.
Important Disclaimers:
- AI reports are advisory only and should not be the sole basis for decisions
- We make no guarantees about accuracy, reliability, or outcomes
- Users retain full discretion in choosing housemates
- We are not liable for compatibility mismatches or unsuccessful arrangements
- AI cannot predict human behavior or guarantee harmonious living
Prohibited Activities
You must NOT use the Platform to:
- List investment properties or properties where you do not reside
- List more than one property simultaneously
- Exceed state-specific room rental limits
- Discriminate based on race, religion, gender, sexual orientation, disability, or other protected characteristics
- Post false, misleading, or fraudulent listings or profiles
- Harass, threaten, or abuse other users
- Engage in illegal activities or facilitate illegal activities
- Use the Platform for short-term rentals or Airbnb-style accommodations
- Scrape, copy, or harvest user data
- Circumvent or attempt to circumvent Platform security measures
- Interfere with the proper functioning of the Platform
- Impersonate others or provide false identity information
- Use automated systems (bots) to access the Platform
Violation of these prohibitions may result in immediate account termination and legal action.
Intellectual Property Rights
Our Intellectual Property
The Platform, including all content, features, functionality, code, design, logos, trademarks, and service marks, is owned by AussieRoomsH3 and protected by Australian and international copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, sell, or create derivative works from any part of the Platform without our express written permission.
Your Content
You retain ownership of content you submit (photos, descriptions, messages). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, display, and distribute your content for the purpose of operating and promoting the Platform.
You represent that you own or have permission to use all content you submit and that it does not violate any third-party rights.
Disclaimers and Limitation of Liability
Critical Legal Disclaimers
1. Platform Provided "AS IS": The Platform is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding reliability, accuracy, availability, or fitness for any particular purpose.
2. No Verification of Users: While we may implement identity verification, we do NOT conduct background checks, criminal record checks, or verify the accuracy of user-provided information. You are solely responsible for your own due diligence.
3. No Guarantee of Outcomes: We do not guarantee you will find suitable accommodation or tenants. We do not guarantee the quality, safety, or legality of any property or arrangement.
4. Third-Party Services: The Platform integrates third-party services (maps, AI, authentication). We are not responsible for failures or issues with these services.
Limitation of Liability
To the maximum extent permitted by Australian law, AussieRoomsH3, its directors, employees, and affiliates shall NOT be liable for:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Personal injury or property damage arising from use of the Platform
- Actions or omissions of other users
- Quality, safety, or legality of properties or rooms
- Disputes between owners and renters
- Failure to pay rent or honor agreements
- Loss or theft of personal property
- AI compatibility report inaccuracies
Our total liability to you for all claims shall not exceed the amount of fees you have paid to us in the 12 months preceding the claim, or AUD $100, whichever is greater.
Note: Nothing in these Terms excludes or limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded under Australian Consumer Law.
Indemnification
You agree to indemnify, defend, and hold harmless AussieRoomsH3, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:
- Your use or misuse of the Platform
- Your violation of these Terms
- Your violation of any law or third-party rights
- Content you submit to the Platform
- Disputes with other users
- Your rental arrangements or occupancy agreements
State-Specific Requirements
Users must comply with all applicable state and territory regulations governing room rentals and boarding arrangements.
South Australia - Special Requirements:
In South Australia, properties with more than one rented room may be classified as "boarding houses" and subject to additional regulations. To avoid this classification, SA owners may only rent ONE (1) room. The Platform automatically enforces this limit for SA properties.
All Australian states and territories permit rental of spare rooms in owner-occupied properties. Users are responsible for understanding and complying with local council regulations, strata bylaws, and any mortgage restrictions.
Dispute Resolution
Disputes Between Users
AussieRoomsH3 is NOT a mediator or arbitrator for disputes between owners and renters. You agree to resolve any disputes directly with the other party. If necessary, you may pursue legal remedies through appropriate courts or tribunals.
Disputes with AussieRoomsH3
For disputes with us regarding the Platform, you agree to first attempt informal resolution by contacting us at legal@aussieroomsh3.com.au.
If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with the Australian Disputes Centre (ADC) Rules. Arbitration shall take place in Sydney, New South Wales.
Account Termination and Suspension
Your Right to Terminate
You may terminate your account at any time through your account settings. Upon termination, your profile and listings will be removed, subject to retention requirements in our Privacy Policy.
Our Right to Suspend or Terminate
We reserve the right to suspend or terminate your account immediately, without notice, if:
- You violate these Terms
- We suspect fraudulent or illegal activity
- You provide false or misleading information
- Your account is subject to legal proceedings
- We cease operating the Platform
General Provisions
Governing Law
These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales.
Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and AussieRoomsH3 regarding use of the Platform.
No Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it in the future.
Assignment
You may not assign or transfer your rights under these Terms. We may assign our rights and obligations to any party at any time without notice.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes via email or prominent notice on the Platform. Continued use after changes constitutes acceptance of the modified Terms.
